India has written constitution that recognizes a range of fundamental
rights. However these rights are potentially quiet broad in their
application to many of the issues that arise in context of the
HIV epidemic. There is a great deal of legislation which pre-dates
the HIV epidemic,as a result, it now affects the legal rights
of People Living with HIV/AIDS (PLWHA), often with anomalous and
undesirable consequences. There is also a vast array of penal
provisions relating to sex between men, injecting drug use and
sex work, which have an immediate and harmful impact on the spread
of HIV, the efforts to contain it, and the rights of those affected.
